Which states are most at risk if Roe v. Wade is overturned? April 19, 2022

What would happen if Roe v. Wade was overturned? Well, first we need to know what sparked this discussion in the first place. The Mississippi Court case of “Dobbs v. Jackson’s Women’s Health Organization”, The state of Mississippi asked the United States Supreme Court to completely overturn Roe v. Wade so they may uphold not only abortion restrictions in their own state, but across the country.

Therefore, if Roe is overturned after all, the legality of abortion will be up to each state. And the outcome isn’t looking too good. So far, 26 states are at risk for complete abortion bans.

Abortion Bans in the US come down to these categories:

  • Pre-Roe ban: Law enacted before 1973 and never removed
  • “Trigger” ban: Law designed to take effect automatically if Roe v. Wade is overturned
  • Eight-week ban: Law prohibiting abortion after eight weeks of pregnancy
  • Six-week ban: Law prohibiting abortion after six weeks of pregnancy
  • Near-total ban: Law enacted after Roe v. Wade to prohibit abortion under all or nearly all circumstances (several of this type are currently blocked by court order)
  • State constitution bars protection: Constitution amended to prohibit any protection for abortion rights

    What an UGLY sight to behold. I’ve never found colors to be ugly until now. Clearly, most states are ready to go if Roe v. Wade is ever overturned.
